MasterCard beats estimates as card payments grow, shares rise

(Reuters) - MasterCard Inc's fourth-quarter results topped Wall Street estimates and revenue growth accelerated as more people chose card payments over cash, sending its stock up 4 percent.

The world's second-largest credit and debit card network earned $605 million, or $4.86 per share, in the quarter, up from $19 million, or 15 cents per share, a year earlier.

The company took a $495 million litigation charge in the year-ago quarter.

Fourth-quarter revenue rose 10 percent to $1.9 billion - the fastest it has grown in three quarters.

Analysts on average expected the company to earn $4.81 per share, excluding items, on revenue of $1.89 billion, according to Thomson Reuters I/B/E/S.

Cardholders made $727 billion of purchases worldwide, on a local currency basis, up 13 percent.

"We are pleased with our fourth-quarter results, which saw double-digit growth in net revenue, cross-border volume and processed transactions," Chief Executive Ajay Banga said in a statement.

Growth in businesses outside the United States led the increase in payment volume. Purchase volumes in Asia-Pacific, the Middle East and Africa grew at 19.5 percent, far outpacing the 7.1 percent rise in the United States.

MasterCard has been focusing on boosting its business outside the United States, where purchase volumes have slowed to the lowest level in 6 quarters.

The company is also trying to capture new business from increasing consumer preferences for digital channels over cash, particularly in Africa where mobile payments are gaining popularity.

Shares of the Purchase, New York-based payment network, which has a market value of more than $64 billion, rose 4 percent to $536.10 in premarket trade. They closed at $516 on the New York Stock Exchange on Wednesday.

Apple boosts fourth-generation iPad to 128GB for $799

iPad review

Apple's iPad line has topped out at 64GB since it was born. That perennial ceiling has been smashed: the company is hiking the capacity of the fourth-generation iPad to a whopping (and only recently rumored) 128GB. The hardware hasn't otherwise changed and preserves both the performance and dimensions that we already know. The WiFi and cellular versions get equal treatment, although we'll pay dearly for the increase at $799 for the base WiFi version and $929 for the cellular edition. Both of the extra-capacious tablets will be available February 5th.

With its portability and all-day battery life, iPad has revolutionized recording for audio professionals allowing artists to record anywhere."

"The bottom line for our customers is winning football games, and iPad running our GamePlan solution unquestionably helps players be as prepared as possible," said Randall Fusee, Global Apptitude Co-Founder. "The iPad's unbeatable combination of security, being thin and light, having an incredible Retina display and also being powerful enough to handle large amounts of data enables us to deliver a product that takes film study to a new level and ultimately gives our users the best opportunity to prepare, execute and win."

The fourth generation iPad features a gorgeous 9.7-inch Retina display, Apple-designed A6X chip, FaceTime(R) HD camera, iOS 6.1 and ultrafast wireless performance**. iOS 6.1 includes support for additional LTE networks around the world***, and iTunes Match(SM) subscribers can download individual songs to their iOS devices from iCloud(R).

Australians clean up from floods; supplies dwindle

BRISBANE, Australia (AP) ? Military personnel headed to flood-ravaged northeast Australia on Wednesday to help clean up the sludgy aftermath of floods that damaged thousands of homes and businesses and left some communities short of power, food and water.

The death toll from the flood crisis rose to five Wednesday when police discovered a man's body in a car submerged in a creek. Another man who vanished while traveling through the same area earlier this week was still missing.

Floodwaters were receding in most places, bringing relief to a region that was battered by worse floods just two years ago. But there were concerns about food and water shortages in some communities and thousands were without power.

Around 120 soldiers were en route to the hardest-hit city of Bundaberg in Queensland, 385 kilometers (240 miles) north of Brisbane. The flooding, caused by the remnants of a tropical cyclone, forced around 7,500 Bundaberg residents from their homes, inundated 2,000 houses and 200 businesses with murky water and prompted helicopter evacuations of 1,000 people.

As the cleanup began Wednesday, some residents complained about dwindling food supplies.

"People were almost coming to blows this morning at the local shop fighting over bread rolls," said Chris Pasky of Moore Park, just outside Bundaberg. "We've got a baby in the house we can't feed. We've just been forgotten."

In Brisbane, residents were warned to conserve water after muddy floodwaters put pressure on the city's water treatment plants. Queensland Premier Campbell Newman told Australian Broadcasting Corp. that stocks of bottled water were ready to be distributed to residents if the reservoirs run dry.

In other areas, officials scrambled to deliver supplies to residents still cut off by the slowly receding waters.

"We're discovering people who are isolated, without power, without water, and we're going to be getting some long-life milk and bread supplies in through four-wheel drive later today," said Pam Parker, mayor of Logan City, south of Brisbane.

In a waterlogged area of Queensland, police have spent days hunting for two men, aged 25 and 34, who disappeared as they traveled separately to work on Sunday near Gatton, about 90 kilometers (55 miles) west of Brisbane. Police said they believed the body found Wednesday was that of the 34-year-old, though formal identification was still pending.

The hunt was still on for the younger man, whose car was found Tuesday in the same creek where the body was recovered.

Queensland residents suffered through the worst flooding Australia had seen in decades in late 2010 and early 2011, when floodwaters from heavy rain killed 35 people, damaged or destroyed 30,000 homes and businesses and left Brisbane under water for days.

Australia has been suffering through a summer of weather extremes, with blistering temperatures and dry conditions igniting hundreds of wildfires across the southern half of the country.

Tomorrow's life-saving medications may currently be living at the bottom of the sea

Jan. 29, 2013 ? OHSU researchers, in partnership with scientists from several other institutions, have published two new research papers that signal how the next class of powerful medications may currently reside at the bottom of the ocean. In both cases, the researchers were focused on ocean-based mollusks -- a category of animal that includes snails, clams and squid and their bacterial companions.

Sea life studies aid researchers in several ways, including the development of new medications and biofuels. Because many of these ocean animal species have existed in harmony with their bacteria for millions of years, these benign bacteria have devised molecules that can affect body function without side effects and therefore better fight disease.

To generate these discoveries, a research partnership called the Philippine Mollusk Symbiont International Cooperative Biodiversity Group was formed. As the name suggests, the group specifically focuses on mollusks, a large phylum of invertebrate animals, many of which live under the sea. Margo Haygood, Ph.D., an OHSU marine microbiologist, leads the group, with partners at the University of the Philippines, the University of Utah, The Academy of Natural Sciences in Philadelphia and Ocean Genome Legacy. Both of these newly published papers are the result of the efforts of this research group.

Here are brief summaries of the two studies:

Shipworms: The source of a new antibiotic

The paper focuses on a unique animal called a shipworm, which despite its name is not a worm. Shipworms are mollusks and are clam-like creatures that use their shells as drills and feed on wood by burrowing into the wood fibers. They are best known for affixing themselves to the sides of wooden ships. Over time, their wood feeding causes serious damage to the hull of those ships.

The research team initially focused on shipworms because the animals' creative use of bacteria to convert wood -- a poor food source lacking proteins or nitrogen -- into a suitable food source where the animal can both live and feed.

This research revealed that one form of bacteria utilized by shipworms secretes a powerful antibiotic, which may hold promise for combatting human diseases.

"The reason why this line of research is so critical is because antibiotic resistance is a serious threat to human health," said Margo Haygood, Ph.D., a member of the OHSU Institute of Environmental Health and a professor of science and engineering in the OHSU School of Medicine.

"Antibiotics have helped humans battle infectious diseases for over 70 years. However, the dangerous organisms these medications were designed to protect us against have adapted due to widespread use. Without a new class of improved antibiotics, older medications are becoming less and less effective and we need to locate new antibiotics to keep these diseases at bay. Bacteria that live in harmony with animals are a promising source. "

Cone snails: Another possible yet surprising source for new medicines

A team led by researchers from the University of Utah, and including OHSU and the University of the Philippines researchers, took part in a separate study of cone snails collected in the Philippines. Cone snails are also mollusks. There have been few previous studies to determine if bacteria associated with these snails might assist in drug development. This is because the snails have thick shells and they can also defend themselves through the use of toxic venoms. Because of the existence of these significant defensive measures, it was assumed that the bacteria they carry do not have to produce additional chemical defenses that might also translate into human medications. The latest research shows that this previous assumption is incorrect.

The research demonstrated how bacteria carried by cone snails produce a chemical that is neuroactive, meaning that it impacts the function of nerve cells, called neurons, in the brain. Such chemicals have promise for treatment of pain.

"Mollusks with external shells, like the cone snail, were previously overlooked in the search for new antibiotics and other medications," said, Eric Schmidt, Ph.D., a biochemist at the university of Utah and lead author of the article.

"This discovery tells us that these animals also produce compounds worth studying. It's hoped that these studies may also provide us with valuable knowledge that will help us combat disease."

Internet Article Marketing Insight from a Pro: How to Effectively ...

Even though many say it's old hat and that search engines like Google don't like it, I still use article marketing quite effectively to market my products (eBooks) and services (SEO writing company) online.

How Effective Has Article Marketing Been for Me

Well, it's kept me on the first page of Google for many keywords relevant to my niches. For example, if you google the phrases "SEO writing"; "what is SEO writing" and "sell eBooks online" (without quotes) ? all keyword phrases that are relevant to my online businesses -- I'm on the first page as of this writing.

Note: Search results change all the time, but I've consistently been on the first three pages of Google for these keyword phrases since 2009-2010. And it's all because article marketing is one of the most consistent weapons in my online marketing arsenal.

What Is Article Marketing?

For those who may be new to internet marketing, article marketing is when you write an article and submit it to article directories so that others can publish it -- for free -- in their newsletter, on their blog / website, in their off-line newspaper, etc.

Why would you give away free content? Because at the bottom of each article is a resource box (ie, "About the Author" section) where you have a link to your website/blog/online store, etc. This drives traffic back to your site.

And, just how much is this traffic worth ? especially if you can parlay it into a first-page listing on Google?

How Much Is a Listing on the First Page of Google Worth?

Apparently, a lot. According to the SeoPledge.com article, How Much Is First Page Google Worth?:

If you able to perform some SEO on your site and move to #10 from #11 you should see a 143% jump in traffic. . . . As you move up the first page, the jumps do get larger.

Where to Submit Articles

As mentioned above, you submit articles to free article directories. There are hundreds of them (just?Google?"article directories" to find a list. FYI, EzineArticles.com is the number one rated article directory on the web. It can be cumbersome to get an article approved there, but it's worth it ? especially if you submit on a regular basis. I've submitted close to 400 articles to this site over the years.

Article Marketing ? The Reason I Sell 5 Figures Worth of eBooks Per Year

I sell four figures worth of eBooks per month (five figures per year). And my number one eBook marketing tactic is article marketing. Now that I've hopefully convinced you of how effective article marketing can be, following are four things you can do to make it effective in 2013 ? and beyond.

4 Effective Article Marketing Strategies for 2013

1. Say Something: As in, write BENEFICIAL information. Article marketing is just another form of content marketing, which means dispensing helpful information to assist web surfers in making an informed buying decision.

Many get frustrated with article marketing; saying it "doesn't work."

Baloney!

It works ? if your article is helpful, meaning you can't just throw together a 300- or 400-word article of generic information that can be found all over the web. That type of info doesn't work; it doesn't move consumers to buy.

But if you invest some time into writing clear, concise, helpful articles to distribute, not only will they generate sales, you'll get greater distribution because prospective publishers will come to rely on the fact that you dispense great info.

2. Write Longer Articles: I remember when an article only had to be 250 words or so to be distributed by article directories. Now, most of them require an article to be at least 400 words. Mine tend to be in the 400 to 600-word range.

FYI, I started my own article marketing directory last year. The link to it is in my bio below; there are tons of samples there.

3. Don't Keyword Stuff: Search engines like Google are moving away from rewarding keyword stuffed content to rewarding what's known as themed SEO content. So, strive for a keyword density of only between 1-2%.

4. Create/Leave a Web Footprint: With Google's emphasis on "Authorship," it's more important than ever to create/leave a footprint on the web. This way, search engines know who you are ? and can reward your content. One of the quickest ways to develop/leave a web footprint is via social media.

So, create and start interacting on social media ? especially the biggies like Facebook, Twitter, LinkedIn and Google Plus.

I got on the first page of Google recently for a keyword phrase I'd been trying to rank for for at ?least six months (SEO content writing) ? all because I shared a piece of content with that keyword phrase in it via my Google Plus profile. Now, I'm in two spots on the first page of Google for this phrase. Go figure!

Article Marketing: Conclusion

You'll come across a lot of negative stuff about article marketing on the web ? especially since Google's Panda and Penguin updates.

SEO Article Marketing: Over 1,000 Articles Written!

Once I learned how to write SEO content in 2007, I upped my article marketing game because knowing SEO is like having the keys to the online marketing kingdom. I've been using this form of online marketing since 2002, and have written over 1,000 articles to promote my own products and services (and a few thousand more for clients via my SEO writing company's article marketing services).

In short, hands down, article marketing is some of the most effective internet marketing you can do. And the best part of all ? it's free!

Time to retire chimps in US research labs?

Scientists have a proposal to retire all but 50 research chimpanzees kept in US federal labs. The primates would be sent to 'Chimp Haven,' a new chimp sanctuary in Louisiana. Animal rights activists applaud the move.

By Janet McConnaughey,?Associated Press / January 23, 2013

The NIH Council of Councils Working Group on Tuesday Jan. 22, 2013 approved a proposal, which also calls for major cuts in grants to study chimps in laboratories and no return to breeding them for research.

Government scientists have agreed that all but 50 of hundreds of chimpanzees kept for federally funded research should be retired from labs and sent to a national sanctuary.

The proposal from a National Institutes of Health committee also said all of the chimps should have plenty of room to play and climb.

The NIH Council of Councils Working Group on Tuesday approved the proposal, which also calls for major cuts in grants to study chimps in laboratories and no return to breeding them for research.

Already, nine chimpanzees arrived Tuesday at Chimp Haven outside Shreveport, La., from the University of Louisiana at Lafayette's New Iberia Research Center, which no longer has an NIH chimp research contract. Seven more are expected Thursday and another 95 will arrive over the coming months, sanctuary officials said.

The federal agency said in 2011 that it would phase out most invasive research on chimpanzees. The new 86-page recommendation describes how chimpanzees should be kept and what will be needed for any future research. Chimps should be used only if there is no other way to study a threat to human health, and the research should be approved by an independent committee with members from the public, said the Council of Councils proposal, which will be sent to the NIH's director after a 60-day public-comment period.

Animal-rights activists said they were pleased by the recommendations.

"At last, our federal government understands: A chimpanzee should no more live in a laboratory than a human should live in a phone booth," the People for the Ethical Treatment of Animals said in a statement.

Chimp Haven was created on 200 acres of a Caddo Parish park in Keithville in northwest Louisiana.

"We should see more than 300 chimpanzees getting moved to the federal sanctuary system," said Kathleen Conlee, the Humane Society of the United States' vice president for animal research issues.

But Conlee said she was disappointed by the recommendation to keep a group of about 50 in case further research on chimpanzees is approved.

"But I'm glad they made clear those animals should be kept to much higher standards than they are currently being kept in," she said.

Chimpanzees should be kept in groups of at least seven, with about 1,000 square feet of outdoor space per chimp ? roughly one-sixth of an acre for a group of seven, according to the proposal.

The space must include year-round outdoor access with a variety of natural surfaces such as grass, dirt and mulch, and enough climbing space to let all members of large troupes travel, feed and rest well above the ground, and with material to let them build new nests each day, the report said.

Chimp Haven's enclosures range from a quarter-acre to five acres, some of them forested and all with climbing structures.

The announcement of its first animals from the University of Louisiana at Lafayette's New Iberia Research Center was delayed a day to keep stress on them to a minimum, officials said.

"Understandably, the chimpanzees are nervous when they arrive, and we do everything possible to ease their stress. That includes limiting the number of people in the area to only those who are required to help with the chimpanzees. We also must minimize the risks of the chimpanzees being exposed to communicable diseases," veterinarian Raven Jackson said in the news release.

A $30 million cap on total spending for construction and care of Chimp Haven's retirees has been looming. That would stop NIH from contributing 75 percent of the $13,000 annual cost to care for each federal chimpanzee.

Conlee said the Humane Society will urge Congress to move money now spent on research contracts to Chimp Haven. The sanctuary gives the animals better care for less money than the labs are paid, she said.

BlackBerry Z10 priced at ?480 SIM-free by purported Carphone Warehouse database leak (update)

BlackBerry Z10 purportedly hits Carphone Warehouse database, 480 unlocked

With all the BlackBerry 10 leaks as of late, it seems inevitable that pricing info would get ousted in the lead up to January 30th. Thanks to an anonymous tipster, it appears that the SIM-free version of RIM's Z10 will cost UKers a cool £480 at Carphone Warehouse (for perspective, a 16GB iPhone 5 would run you just roughly £30 more). The leak comes from what's said to be a snapshot of the company's internal database, listing the white variant. The attached BLAZ10WHI model number also syncs up nicely with the previous slip from the retailer. At this rate, not much is going to be left to the imagination when RIM officially unveils its devices come Wenesday -- who likes surprises anyway, right?

Update: We've updated the post to reflect that the phone was touted to us as "SIM-free," specifically.

Cambodia reports 3 new bird flu cases, 2 fatal

PHNOM PENH, Cambodia (AP) ? Cambodia on Friday reported three new human cases of bird flu, two of them fatal, in the first three weeks of this year. That's as many cases as the Southeast Asian country reported in all of 2012.

The cases are among the first reported in 2013 for the virulent H5N1 virus, which the World Health Organization says has killed 360 other people worldwide since surfacing in 2003.

WHO and Cambodia's health ministry announced that a 15-year-old girl in a village in southeastern Takeo province and a 35-year-old man in central Kampong Speu province died after being hospitalized with H5N1, better known as bird flu. An 8-month-old boy in the capital, Phnom Penh, was treated and survived.

Cambodia reported three cases last year, all of them fatal. Since 2005, it has recorded 21 cases, 19 of them fatal.

The disease remains hard for people to catch, but experts fear it could mutate into a more deadly form that spreads easily from person to person. So far, most human cases have been linked to contact with infected poultry.

On Wednesday, international scientists who last year halted controversial research with the deadly bird flu virus said they were resuming their work as countries adopt new rules to ensure safety.

An outcry had erupted when two labs ? in the Netherlands and the U.S. ? reported they had created easier-to-spread versions of bird flu. Amid fierce debate about the oversight of such research and whether it might aid terrorists, those scientists voluntarily halted further work last January.

Those scientists announced Wednesday they were ending their moratorium now that health authorities have had time to determine how they will oversee high-stakes research involving dangerous germs. Several countries have already issued new rules.

In letters published in the journals Science and Nature this week, scientists wrote that those who meet their country's requirements have a responsibility to resume studying how the bird flu might mutate to become a bigger threat.

First clip from the jOBS movie released, Woz says it?s not even close to what actually happened

First clip from the jOBS movie released, Woz says it?s not even close to what actually happenedThe first clip from the upcoming jOBS movie starring Ashton Kutcher as the late Steve Jobs and Josh Gad as Steve Wozniak has been released. In the short clip it shows Steve and Woz discussing how Woz has the ability to create a personal computer that actually displays information on a screen in real-time. The clip was discovered by Gizmodo and Steve Wozniak jumped into the original posts comments to have his say on the accuracy of the clip.

Not close...we never had such interaction and roles...I'm not even sure what it's getting at...personalities are very wrong although mine is closer...don't forget that my purpose was inspired by the values of the Homebrew Computer Club along with ideas of the value of such machines and Steve J. wasn't around and didn't attend the club so he was the one learning about such social impact of the future.

I never looked like a professional. We were both kids. Our relationship was so different than what was portrayed. I'm embarrassed but if the movie is fun and entertaining, all the better. Anyone who reads my book iWoz can get a clearer picture.

Of course the film was never going to be an exact replica of what actually went on back in those great days but the first available clip does appear to miss the mark by quite a bit; which is really disappointing. If you are looking for a film to closely represent what actually happened, you may have to wait a bit longer for the film being written by Aaron Sorkin and produced by Sony, which is based on the official Walter Isaacson biography of Steve Jobs.

Ten years ago, as I prepared to take part in the invasion of Iraq, I never thought women would be allowed to serve in combat jobs in the U.S. military, at least not in my lifetime. To be honest, I wasn?t even sure it was a good idea.

Some of my male comrades in the 101st Airborne Division (Air Assault) had even clearer thoughts on the question. They told me, sometimes to my face, that I didn?t belong in the military at all, much less in a combat zone. Women serving in the infantry was simply anathema to them.

Then we crossed the berm into Iraq and drove into Baghdad. Suddenly, my skills as an Arabic linguist were more important than my gender: On combat foot patrols with infantry troops, my ability to help successfully accomplish the mission was the only thing that mattered. During major combat operations, the fact that I was a woman was only meaningful if my presence made it easier for the guys to interact with local women. Some Iraqi women were prevented by custom or religion from talking to men; others were simply terrified of huge soldiers strapped in military gear suddenly appearing at their door. The presence of another woman sometimes calmed them and give them the comfort level to tell us about threats in their neighborhood.

After I returned home, I started to question my earlier doubts. In time, I became convinced that although the older generation of military leaders may not have been prepared to see women attain full equality in uniform, the troops I served alongside would be ready once they moved into leadership positions. They would have seen women medics, helicopter pilots, and food specialists serve in combat. Women like Monica Lin Brown, an Army medic who was awarded the Silver Star for her combat valor in Afghanistan; Tammy Duckworth, a helicopter pilot who lost both her legs due to injuries sustained in combat in Iraq; and Shoshana Johnson, a food service specialist who became the first African American female POW when her unit was ambushed in Iraq.

The men and women I served with saw that Americans did not rise up in protest when more than 150 female U.S. servicemembers gave their lives in Iraq and Afghanistan. Rather, the public accepted that women who chose to volunteer for military service did so knowing the risks, and grieved for them just as they did for the men who made the ultimate sacrifice.

Those who served in Iraq and Afghanistan came to understand that in complex counterinsurgency operations, especially in Muslim nations, the presence of women troops is a vital way to interact with the civilian population?so important, in fact, that military leaders have long been skirting the old regulations by placing women in combat units.

Today, when Secretary of Defense Leon Panetta announces the repeal of the combat ban on women soldiers, the policy will finally catch up to the reality that many of us who have served in Iraq and Afghanistan already know. It will be now be up to the services to demonstrate that women should be banned from specific jobs, rather than there being a blanket ban on women in all ground combat roles and smaller units whose primary mission is direct ground combat. It is a tremendous step forward. The fact that the final push has come from within the military speaks volumes for how vital women have become to operational success.

Much work remains to be done to implement this landmark reform. It is likely that the military will follow a multiyear process for phasing in changes, similar to that planned by the Australian military. Australia began allowing women to transfer between services into combat roles this month and will allow female recruits to enter those jobs directly in January 2016. The Aussies believe these changes will be fully implemented later that same year.

The U.S. military services (particularly the Army and Marines) may argue that some jobs, particularly in the Special Forces, should remain closed to women. But as women continue to prove their abilities in a growing number of positions, those exclusions will become harder to justify.

It is true that not all women can handle the physical demands of military service. However, neither can all men. In fact, only 25 percent of today?s young people qualify for military service at all?the rest are too obese, too poorly educated, or have criminal backgrounds that bar them. Today Panetta is acknowledging that to maintain the high standards of the military, assignments should be based on ability, not gender.

There will be challenges, just as there are with any policy change across the military. However, the dire predictions of catastrophe in the wake of the repeal of ?don?t ask, don?t tell? were gratifyingly overwrought. The pundits who claimed the military would not be able to handle gays serving openly are typically the same ones who argue against women serving equally; I am convinced they will be just as wrong this time as they were then. Today women in the military will revel at the news. Tomorrow they will go back to work.

Alternative Statutory Bases for Invalidating ?Gene Patents?

The Supreme Court recently granted a writ of certiorari in the highly controversial case Association for Molecular Pathology v. Myriad. In the coming months, the Court will determine whether the genetic material claimed by Myriad?s composition patents is patentable subject matter under Section 101 of the Patent Act. The high profile case has generated a widespread debate often framed as whether genes should be patentable. To the extent that the patentability of genetic material is not the specific question at issue in Myriad, such publicity may be misleading or overstate the impact of the Supreme Court?s decision. This post seeks to serve as a reminder that a holding in favor of Myriad would only establish that the claims at issue meet one of the many requirements of our patent system.

The nonobviousness and written description requirements set forth in sections 103 and 112 of the Patent Act provide additional and, some argue, more effective filters for claims directed towards genetic material. According to some academics, these requirements have been much further developed in the case law, are more finely tuned to address patents on genetic material, and provide more appropriate filters for separating truly inventive additions to human knowledge from unpatentable matter. Two landmark cases illustrate how these requirements have been used to invalidate claims directed towards genetic material.

First, the Federal Circuit invalidated patent claims for failing to meet the written description requirement in Regents of the University of California v. Eli Lilly & Co. The patent specification described cDNA encoding rat insulin, which the court held did not give the patentee a right to also claim the cDNA encoding human insulin. The court emphasized that even if the disclosure was sufficient to enable a person of skill in the art to make and use that cDNA, it still failed to meet the written description requirement. On the other hand, the court noted, a recitation of the actual nucleotide sequence would suffice. As some scholars argue, the requirement so applied compels applicants ?to spell out the exact sequence of all the DNA they hope to claim, rather than just the function of the genes.? Denise DeFranco argues that the primary goal of applying the requirement in this way to biotechnology patents ?is to limit inventors to their actual inventions.? Indeed, at the time the Plaintiffs in Eli Lilly applied for the patent claiming human insulin, they had only cloned the rat insulin gene, and did not clone the human insulin gene until two years later.

In another significant biotechnology case in 2009, In re Kubin, the Federal Circuit invalidated patent claims on obviousness grounds. The case involved a claim to the isolation and sequencing of a gene encoding a protein domain known as NAIL. In light of the prior art references, which taught a prophetic method for isolating the gene that codes for the NAIL protein as well as a probe specific to the protein, the court held that the claims were invalid. Prior to this holding, similar patents had been upheld even when the prior art included as much or more information as that considered in Kubin, such as the actual polypeptide sequence of the protein at issue and not just a probe for the protein. This decision has thus been characterized as ?a major change in the law that will lower the bar for finding biotechnology patents obvious.? Joanne Kwan postulates that following Kubin, biotech inventions such as claims to isolated genes that encode particular proteins may now be routinely invalidated as obvious under Section 103.

This post does not comment on the social desirability of allowing patents on genetic material, nor on the legal merits of the arguments in Myriad. Rather, it seeks to highlight that the question raised by the patentable subject matter challenge in Myriad is a narrow one, a ?coarse eligibility filter? in the words of the Federal Circuit. The Patent Act provides a number of other requirements to ensure that patents on genetic material aren?t improvidently granted when, for example, the inventors have not actually cloned the gene they are claiming, or when the protein of interest, a motivation to isolate the gene coding for that protein, and illustrative instructions for cloning the gene already exist in the prior art. Regardless of the precedent ultimately set by Myriad, these and other additional statutory requirements will continue to have a significant impact on the validity of patent claims directed to genetic material.

(AP) ? A France-based human rights group is warning about dozens of "summary executions" and other abuses allegedly committed by Malian troops as they counter-attack jihadists holed up in the West African country's hinterlands.

The International Federation for Human Rights, or FIDH by its French acronym, is calling for the creation of an independent commission to look into the crimes and punish those responsible.

The group said Wednesday that Malian forces were behind about 33 killings ? including of ethnic Tuaregs ? since Jan. 10 along the narrow belt between the government-controlled south and the north.

FIDH didn't specify the source of its information. Journalists have been refused access to the area while trying to cover the French intervention that began Jan. 11 in support of Malian forces against the jihadists.

Young women and cervical cancer: Pap smear is key | theGrio

Tamika Felder at the annual ?Walk to Beat the Clock? at RFK Stadium in D.C., May 2012

Tamika Felder used her difficult experience with cervical cancer as an opportunity to educate and encourage others.

Quita Gibson and her son Avian. In 2007, Quita Gibson was diagnosed with cervical cancer days after an annual Pap smear.

- of 3

Approximately 4,200 women die from cervical cancer each year and research shows when African-American women are diagnosed they are twice as likely to die as their Caucasian peers.

Regular Pap smear testing is vital in preventing and diagnosing the disease, otherwise a woman will not know she has it.

At age 25, that was Tamika Felder?s experience. If not for a doctor?s visit to investigate a boil under her arm, Felder would not have known that she had cervical cancer.

?After I graduated from college, I got a freelance gig with no benefits. I went without health insurance for several years, which meant I could not get annual testing. Then I landed a job with insurance benefits. Shortly after I got the job, I went to the emergency room because of a boil, and the doctor happened to ask me when I had my last Pap smear,? says Felder, who was diagnosed in 2001.

?Since I had not had a Pap smear, the emergency room doctor ordered one and that is how I was diagnosed, otherwise I would not be here,? Felder says.

Following the diagnosis, Felder had a full or radical hysterectomy, chemotherapy and radiation?and was left without the ability to bear children. She also became one of the estimated 11,967 women who are diagnosed with cervical cancer every year.

The treatment, Felder says, ?was very difficult and I felt like I lost my chance for a happily ever after, but when I think about women who are no longer here, I feel like I cannot complain because they left families behind.?

Most cervical cancer cases are caused by the HPV virus or the human papilloma virus. HPV, a very common sexually transmitted infection, is transmitted by skin-to-skin contact.

Although Hispanic women have higher incidences of cervical cancer compared to other ethnicities, African-American women are 40 percent more likely to develop the disease, and tend to have lower five-year survival rates, too. These statistics are often attributed to lack of regular Pap smear screenings, but one study sponsored by the National Institute on Minority Health and Health Disparities suggests this is also because African-American women have a more difficult time ridding the HPV virus from their systems.

?There are no symptoms for HPV and early cervical cancer is often asymptomatic,? says Dr. Estelle Whitney, a physician at Christiana Care Health Systems in Delaware. ?So it?s important for women to get regular Pap smears.?
Felder used her difficult experience as an opportunity to educate and encourage others about cervical cancer. In 2005, she formed Tamika and Friends, a nonprofit organization dedicated to raising awareness about cervical cancer and its link to HPV. January is cervical health awareness month, and Felder stresses that routine screenings such as the Pap smear test make cervical cancer one of the most preventable forms of cancer.

Dr. Peter Grossman, an Augusta, Ga.-based obstetrician-gynecologist echoes that fact with other positive points about prevention and treatment.

?Well, there are four great things we know about cervical cancer: We have a precursor in cervical dysplasia (abnormal changes in the cells on the cervix surface); We know the cause, which is HPV; We have a great screening test with the Pap smear; and it takes a long time to develop, about 10 to 20 years from the initial exposure to HPV to the development of cervical cancer,? Grossman explains.

There are many different strains of HPV and Grossman says, ?There are probably about 20 types associated with cancer of the genital tract, but 90 percent of them are associated with two particular strains, HPV 16 and HPV 18.?

According to the Centers for Disease Control and Prevention, vaccines [such as Gardisil? and Cervarix?] protect against the HPV types that most often cause cervical, vaginal, and vulvar cancers. Vaccines are recommended for 11- and 12-year-old girls, and also can be given to females ages 13?26 who did not get any or all of the shots when they were younger.

Risk factors include a compromised immune system, chlamydia, being overweight, multiple sexual partners, and unprotected sex. Smoking also compounds the risk of developing cervical cancer.

?[Cancer-causing molecules from smoking] embed themselves in cervical mucus, and women who smoke are less likely to clear the HPV virus,? Grossman says.

Though routine testing is critical, Pap smears are not 100 percent, Grossman says. There is a 20 to 30 percent chance of a false-negative where the test does not pick up a cancerous lesion.

In 2007, Quita Gibson was diagnosed with cervical cancer days after an annual Pap smear.

?I didn?t understand why it was happening to me because I did what I was supposed to. I got a Pap smear every year,? Gibson says.

Fortunately, Gibson was diagnosed at stage 1A1, which is early, and after discussing treatment options with her doctor, she elected to only remove her cervix instead of a full hysterectomy. Even so, she was told her chances of conceiving a child, or carrying a baby to term, would be slim even with fertility drugs. But Gibson became pregnant about two years after being cancer free. Her son Avian will be four this August.

Like Felder, Gibson uses her experience to raise awareness. She founded Walk2Inspire, and hosts information events and walks in her community.

Felder beat the odds, too, and she got the happily-ever-after she feared cervical cancer had robbed her of. She is engaged to be married this spring. ?I am engaged to a wonderful man and he has a daughter, so I?m going to be a stepmom,? Felder says.

Felder admits she still has rough days sometimes, but finds strength in educating others about the importance of Pap smear testing.

?Preventing cervical cancer is the easy part. It?s one of the only cancers that we know cause of?and it?s one of the ones we can start winning the war against,? Felder says.

You?re at higher risk of developing cervical cancer if:

  • You have chlamydia, a common sexually transmitted disease.
  • You eat only a few fruits and vegetables.
  • You are overweight.
  • You take oral contraceptives (birth control pills).
  • You have had multiple full-term pregnancies.
  • Your mother or sister had cervical cancer.
  • Your mother took a drug called diethylstilbestrol (DES) while she was pregnant with you.

Google announces Q4 2012 earnings: impressive revenues of $14.42 billion, excluding Motorola Home

Google announces Q4 2012 earnings impressive revenues of $1442 billion, excluding Motorola Home

Earnings season is swinging into high gear and today's big player is Google. The internet giant just announced its earnings for the fourth quarter of 2012, and unsurprisingly it's still raking in the dough. For the three month period ending December 31st, 2012 the company pulled in $14.42 billion in revenue -- a staggering 36 percent increase year-over-year. That doesn't even include revenue generated by Motorola's recently spun off Home division, which would have pushed the total to $15.24 billion. 2012 also marked the first year that the company broke the $50 billion barrier for total revenues. Of course, bringing in all that money means nothing if you can't actually turn a profit. Good news for investors is that Google saw a net income of $2.89 billion this quarter, up from $2.71 billion the same time last year and $2.74 billion last quarter. Not surprisingly, a large chunk of that cash is coming from Google's own properties and advertising -- with Google-owned sites accounting for 67 percent of revenues and ads pulling in $12 billion on their own.

Obviously, a vast majority of Big G's income is coming from the US, $5.99 billion in this quarter, but international markets are still hugely important for the company. 53 percent of its revenues came from overseas ventures, including $1.3 billion from the UK alone.

Motorola Mobility, on the other hand, isn't faring so well. While pulling in $1.51 billion in revenue, the phone manufacturer lost $353 million as its new parent company continues to try to turn around the business. Whether or not Mountain View is succeeding is debatable as revenues continue to drop and losses increase for the beleaguered, former icon. There is a sizable war chest at its disposal however, as Google claims to have $48.1 billion in cash or its equivalent on hand. Update: Larry Page briefly touched on the ongoing drama over Nexus 4 stock saying, "clearly there's work to be done managing our supply better, and that is a priority to our teams." Though, we're not sure how much control Page actually has over that.

Nickesh Arora, Google's Senior Vice President and Chief Business Officer, took a pretty big chunk of time to talk about the spread of YouTube and the earning power of ads. In case you continue to doubt that the streaming service is a viable money-making platform, Arora said he estimates Gangnam Style has raked in $8 million through ads. Who said making an ass of yourself isn't a viable career choice?
